ISTA ENCORE — TERMS OF USE

These Terms of Use govern your access to and use of the online courses, memberships, and digital resources provided by ISTA Global Arts Learning via the ISTA Encore platform and related websites (“Platform”). By creating an account, purchasing a product, or using the Platform, you agree to these Terms.
1) Who we are
"ISTA Global Arts Learning”, “ISTA”, “we”, “us”, and “our” refer to ISTA Global Arts Learning Ltd, a company limited by guarantee registered in England & Wales and a registered UK charity (see Legal & Contact).
2) Definitions
Products: any online course, video workshop, digital resource, subscription or membership offered on the Platform.
Standalone Course: a one-off course purchased separately and not as part of a subscription.
Subscription: an ISTA Encore membership providing time-limited access to a catalogue of Products.
3) Accounts & eligibility
3.1 You must create an account to access most Products and keep your login details confidential.
3.2 You are responsible for all activity that occurs under your account.
3.3 You agree to provide accurate information and to update it as needed.
4) Access to Standalone Courses (life span & retirement)
4.1 When you purchase a Standalone Course, you receive access for the duration of that course’s life span on the Platform.
4.2 ISTA may withdraw or retire a Standalone Course if it becomes out-of-date, redundant, superseded, or no longer meets our educational or technical standards.
4.3 Where reasonably possible, we will give advance notice of withdrawal and/or a reasonable window to complete the course before removal.
4.4 Unless required by law, retirement of a Standalone Course within its life span does not entitle you to a refund or credit; your statutory rights (if applicable) remain unaffected.
5) ISTA Encore Subscription (catalogue changes & shelf life)
5.1 An ISTA Encore Subscription provides access to a changing catalogue of Products. We regularly add new content and may remove older titles.
5.2 We retain the right to add and remove Products/titles at any time.
5.3 Where a Product has a known shelf life (e.g., curriculum/version expiry or licensing constraints), we will make reasonable efforts to indicate this on the Product page or catalogue.
5.4 Catalogue changes during your active Subscription do not give rise to refunds or credits, unless required by law.
6) Pre-order courses
6.1 If you purchase a course on pre-order, your access will begin only once the course is released.
6.2 Any release dates provided are indicative and may change without notice.
6.3 If a pre-ordered course is significantly delayed or cancelled, we will offer the choice of a full refund or credit towards another Product.
7) Pricing, billing & renewals
7.1 Prices are shown in the currency indicated at checkout and may change from time to time.
7.2 Subscription fees are billed in advance and auto-renew unless you cancel before the renewal date in your account settings.
7.3 Unless required by law, we do not provide pro-rata refunds for partially used Subscription periods.
7.4 If you are purchasing in a currency different from GBP, your payment provider may apply currency conversion fees — these are the responsibility of the purchaser.
8) Certificates & PD recognition
8.1 Certificates of completion are provided for most courses as a record of your learning.
8.2 These certificates are not formal qualifications and are not accredited by any government or awarding body.
9) Licence & permitted use
9.1 All content on the Platform is licensed, not sold. You receive a personal, non-transferable, non-exclusive licence to use Products for your own educational purposes.
9.2 Account sharing is not permitted. One account = one user, unless we have agreed to an institutional or multi-seat licence in writing.
9.3 You may not copy, redistribute, record, reupload, resell, or make Products available to others without ISTA’s prior written consent.
10) Digital downloads & classroom materials
10.1 Where downloads are provided, they are licensed for your personal classroom use only (or, if purchased by an institution, for internal use by the licensed cohort).
10.2 You must retain any copyright/attribution notices and may not remove watermarks or other identifying marks.
11) Technical requirements
11.1 You are responsible for ensuring you have suitable hardware, software, and internet access to use the Platform.
11.2 ISTA is not liable for any inability to access the Platform caused by your equipment, software, internet connection, or restrictions at your location.
12) Service availability & changes
12.1 We aim to provide reliable access but do not guarantee uninterrupted service. Maintenance, updates, or third-party outages may affect availability.
12.2 We may modify features, interfaces, or delivery methods to improve the Platform.
13) Third-party tools & links
13.1 The Platform may integrate third-party services. We are not responsible for third-party content or policies. Your use of third-party services is at your discretion and subject to their terms.
14) Conduct
14.1 You agree not to misuse the Platform (e.g., unlawful activity, harassment, infringement, attempts to bypass security, or unauthorised scraping/automation).
15) Termination for breach
15.1 ISTA may suspend or terminate your account without refund if you breach these Terms, misuse the Platform, or infringe intellectual property rights.
16) Intellectual property
16.1 All intellectual property rights in the Platform and Products remain with ISTA or our licensors.
16.2 Nothing in these Terms transfers ownership to you.
17) Refunds & statutory rights
17.1 Our general policy is no refunds for partially used Subscription periods or retired Products (see Sections 4 and 5).
17.2 If you are a consumer in the UK or EU, your statutory rights remain unaffected.
18) Changes to these Terms
18.1 We may update these Terms. The current version will be posted with the “Last updated” date. Continued use after changes constitutes acceptance.
19) Governing law
19.1 These Terms are governed by the laws of England and Wales. Courts of England and Wales shall have non-exclusive jurisdiction.
